Welcome to www.yellowdogflyfishing.com (the “Site”), operated by Yellow Dog Flyfishing LLC (referred to as “Yellow Dog Flyfishing,” “we,” “us,” or “our”). These Terms and Conditions of Use ("Agreement" or "Terms of Use") outline the terms governing your access to and use of the Site, including all related content, promotions, programs, and services provided through the Site.

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR USING ANY PART OF THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MUST NOT ACCESS OR USE THE SITE.

GENERAL TERMS

These Terms of Use form a legally binding agreement between you and Yellow Dog Flyfishing. By accessing any part of the Site or placing an order with us, you agree to comply with and be bound by all the terms and conditions outlined in this Agreement. These Terms of Use define your rights and responsibilities related to your access to and use of the Site. If you have any questions about these Terms, please reach out to us.

ACCEPTANCE OF TERMS

BY ACCESSING AND USING ANY PART OF THE SITE OR PURCHASING PRODUCTS FROM US, YOU EXPRESSLY ACKNOWLEDGE, REPRESENT, AND AGREE THAT YOU:

(A) ARE AT LEAST 18 YEARS OLD;

(B) HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS OF USE;

(C) ACCEPT THAT THESE TERMS OF USE ARE LEGALLY BINDING;

(D) ARE NOT LOCATED IN A COUNTRY SUBJECT TO A U.S. GOVERNMENT EMBARGO OR DESIGNATED AS A “TERRORIST-SUPPORTING” COUNTRY;

(E) ARE NOT INCLUDED ON ANY U.S. GOVERNMENT LIST OF PROHIBITED OR RESTRICTED PARTIES; AND

(F) WILL ABIDE BY THESE TERMS OF USE AND ALL APPLICABLE LAWS AND REGULATIONS.

UPDATING TERMS

We reserve the right, at our discretion, to change, delete, and update these Terms of Use and any related policies at any time, for any reason, and in our sole discretion. We also reserve the right to discontinue the Site, any portion of the Site, any products, and/or to terminate your access to or use of the Site. It is your responsibility to periodically review these Terms of Use for changes. Any amendments or modifications we make will be effective upon posting on the Site. Your continued access or use of the Site after these Terms of Use have been updated constitutes your acceptance of such changes.

PRIVACY

We are committed to transparency in how we collect, use, and share data. The terms of our Privacy Policy apply to your use of the Site and are incorporated by reference. It is your responsibility to read and understand our Privacy Policy, which we may update from time to time.

MINORS

The Site is designed for use by individuals who are at least 18 years of age. If you are under 18, you may not submit any personally identifiable information to us through the Site unless your parents have first provided us with verifiable parental consent.

REGISTRATION

If you register or provide personal contact information through our Site, you agree to provide truthful, accurate, and reliable information about yourself. If you obtain a username and password in connection with your registration, you agree to safeguard the confidentiality of your password and agree that you will not disclose or share the password with any third parties. You are responsible for all activities that may occur under your username or password.

OWNERSHIP RIGHTS

We (a) own or license all the content, materials, and other intellectual property related to the Site, including, without limitation, all trademarks, logos, text, graphics, photographs, music, data, images, audio and video clips, software, names, button icons, logos, images, designs, look and feel, compilation, titles, words or phrases, page headers, service names, advertisements, promotions, trademarks, patents, and copyrights (collectively, “Materials”); and (b) expressly reserve all rights, title, and interest in and to the Materials. You have no rights to use the Materials except as expressly set forth in these Terms of Use. Any use of the Materials that is not expressly authorized by these Terms of Use is prohibited.

Yellow Dog Flyfishing respects the intellectual property of others. If you believe that intellectual property owned by you or a third party has been copied or used on the Site in any way that constitutes copyright infringement or other intellectual property infringement, please contact Yellow Dog Flyfishing’s Legal Advisor, our agent for notification of claims, at the address below, providing all relevant information.

LIMITED LICENSE

Subject to these Terms of Use, we grant you a limited, non-exclusive license to access and use the Site for your non-commercial, personal, and informational use and/or to obtain products, services, rewards, or information from us. You may not use any part of the Site for commercial purposes, to compete with us, or to harm us in any way.

INFORMATION SECURITY

When you provide us with information online, including when you apply for a job, you understand and expressly agree that there is a risk of fraud or security breach. While we take industry-standard efforts to protect your transactions and sensitive information, we disclaim any and all warranties that such transactions will be error-free or may not be subject to third-party security breaches. You waive all claims relating to the same.

EMAIL AND MOBILE MARKETING COMMUNICATIONS

We use email and mobile advertising. You may always opt out of our email and text messaging/SMS marketing programs as follows:

• Emails: Each marketing email contains an automated way to unsubscribe. Simply follow the “Unsubscribe” link at the bottom of any marketing email.
• Mobile Marketing Communications: For details, please refer to our Mobile Terms of Service and our Privacy Policy.

MOBILE TERMS OF SERVICE

The Yellow Dog Flyfishing mobile message service (the "Service") is operated by Yellow Dog Flyfishing (“Yellow Dog Flyfishing”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Yellow Dog Flyfishing’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Yellow Dog Flyfishing through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Yellow Dog Flyfishing. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18337896588 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Yellow Dog Flyfishing mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

SECURITY

We make no guarantees regarding the security of the Site. To protect your information:

• Use complex passwords with unique numbers, letters, and special characters.
• Keep your software updated with the latest browser and antivirus tools.
• Be cautious of phishing emails or suspicious links.

INTELLECTUAL PROPERTY

All Materials accessible on the Site are owned by Yellow Dog Flyfishing and are protected by U.S. and international copyright, trademark, and other laws. You may not copy, distribute, modify, or use these Materials without our prior written consent.

FAIR & TRUTHFUL ADVERTISING

We expect truthful and transparent advertising practices. If you post testimonials or endorsements about our products or services, you must disclose any affiliation, compensation, or value received from Yellow Dog Flyfishing.

PROHIBITED CONDUCT

You may not:

• Violate the security of the Site or interfere with intellectual property rights.
• Upload harmful code, malware, or unsolicited advertising to the Site.
• Misrepresent your identity or affiliation with Yellow Dog Flyfishing.
• Use the Site to post threatening, defamatory, or unlawful material.

We reserve the right to terminate your access to the Site if you engage in prohibited activities.

TERMINATION, REMOVAL OF MATERIALS, AND MONITORING

These Terms of Use remain effective until terminated. We may terminate your access to the Site at our discretion without prior notice. We are not obligated to monitor Site content or user activities.

WEBSITE LINKING

The Site may include links to third-party websites for your convenience. We are not responsible for the content or practices of third-party websites and recommend reviewing their terms and policies.

TRANSACTIONS

Yellow Dog Flyfishing reserves the right to refuse or limit any order. If changes are made to your order, we will notify you via the contact information provided during checkout.

DISCLOSURE OF YOUR IDENTITY AND USE

We reserve the right to disclose your information as necessary to comply with laws, protect our rights, or respond to legal requests.

VIRUSES

We cannot guarantee the Site is free of viruses or malware. It is your responsibility to scan and protect your devices.

DISCLAIMERS AND LIMITATION OF LIABILITY

Your use of the Site is at your own risk. To the extent permitted by law, Yellow Dog Flyfishing disclaims all warranties and liability for damages, including indirect or consequential damages, resulting from your use of the Site.

INDEMNIFICATION

You agree to indemnify and hold harmless Yellow Dog Flyfishing and its affiliates from claims, liabilities, or expenses arising from your use of the Site or violation of these Terms of Use.

APPLICABLE LAW

These Terms are governed by the laws of the State of Montana. Any disputes shall be resolved in courts located in Gallatin County, Montana.

TRIP CANCELLATION POLICIES

Cancellation policies differ between each operation and lodge throughout many of our lodge partners. Please follow the directions below to see specific cancellation policies for each operation and lodge. Please be aware that Yellow Dog Flyfishing general terms and conditions are always superseded by those of the individual lodges and outfitters that we work with and represent. IN ADDITION TO THE LODGE'S CANCELLATION POLICY, upon cancellation Yellow Dog Flyfishing, L.L.C. has the right to assess a $100.00 handling charge to all deposits and payments received in the event of date changes, transfers or cancellations. Because payments for most lodge packages are non-refundable, Yellow Dog strongly recommends that anglers and guests purchase travel insurance.

To locate the Terms & Conditions specific to the lodge and/or operation you are traveling to, follow the steps below:

1. Utilize the search filter at the top of the page and type in the name of the lodge. Or, utilize the dropdown "Destinations" tab to locate the region you are traveling to. From there, select the lodge.  
2. Locate Rates & Terms within the lodge's accommodation, travel, and fishing details. Underneath "Toggle Between Categories," users will find a Rates & Terms category. 
3. Underneath inclusions/exclusions, cancellation and booking terms specific to the destination are provided. 

DEPOSIT AND PAYMENT INFORMATION
The following terms and conditions apply to all offers or trips booked and organized by Yellow Dog Flyfishing, L.L.C (“Yellow Dog”). Please read these terms and conditions carefully. Booking a trip, making a deposit, or making a final payment shall be considered acknowledgment that the customer has read and accepted all the terms and conditions contained herein.

Please be aware that Yellow Dog’s terms and conditions are in addition to any terms and conditions of the individual lodges and outfitters that we work with and represent. In instances where Yellow Dog’s general payment and cancellation terms are different from those of individual lodges or outfitters, the terms of the lodges or outfitters will take precedent and become the terms and conditions that apply to related trip packages.

• A 50% deposit per angler of the total package cost for each trip is due to Yellow Dog at the time of booking to secure the trip reservation. In many cases (depending on the destination being booked) deposits are non-refundable. Please view the destination-specific lodge and outfitter list at the bottom of this page to see what refund terms apply to each destination.
• Yellow Dog reserves the right to charge a handling fee of $100.00 per person for any date changes after the initial reservation has been made. Date changes to trips that are already booked (if possible) must be approved and accepted by the individual lodge(s) or outfitter(s). Some lodge(s) or outfitter(s) may not be able to offer date changes.
• Full payment for all Yellow Dog trips is due 90 days prior to departure and start of trip.
• Beginning September 1st, 2020, Yellow Dog will apply a 3% convenience fee for all credit card transactions.
• When a trip is invoiced at a double occupancy, per person rate, the final invoice amount will be changed to a single occupancy / single supplement rate in all instances where an invoiced double occupancy rate based on an even number of anglers is changed to a single angler situation or odd number (in the case of two or more anglers traveling together or with group travel. Odd numbers of anglers will necessitate a single angler / single supplement fee if changes to a reservation or made or if numbers change from an even number of anglers to an odd number.

REMINDER ON SECURE PAYMENTS
We would like to remind you that when you work with Yellow Dog, you will never be asked via email to provide personal financial information or to initiate a wire transfer. Our preferred and secure forms of payment remain:

• Payment through the secure Yellow Dog ACH Link
• Check sent by mail
• Credit card payment over the phone (with a +3% convenience fee added)

If you receive an email from Yellow Dog that requests money in the form of a wire, it should be disregarded. If you do want to pay your invoice with a wire transfer, we would be happy to accept the payment, but it will need to be done over the phone for security purposes. Please call with any questions.

MEDICAL, TRAVEL AND TRIP INSURANCE – HIGHLY RECOMMENDED!
Many deposits and final payments for trip packages are non-refundable so it is highly recommended that you purchase medical, travel or trip insurance if you must cancel, postpone, or reschedule your trip for any reason. Please be aware that this is the only way that Yellow Dog can assist you with compensation for a cancelled trip. Customers are solely responsible for purchasing medical, travel or trip insurance and it is not included in any quote or invoice from Yellow Dog. All medical, travel or trip insurance companies are third party service providers. For more information or assistance in purchasing medical, travel or trip insurance, please contact Yellow Dog for recommendations or visit the section on the Yellow Dog website about Travel Insurance. In light of COVID-19 or any other similar virus, we do know that many standard trip insurance policies will not cover cancellations or offer compensation due to pandemics, epidemics or fear of travel, which is why “Cancel For Any Reason” policies are highly recommended. Please read and research all trip insurance policy details to fully understand coverage.

GENERAL CANCELLATION / REFUND POLICY FOR YELLOW DOG TRIPS
Upon trip cancellation on the part of or based on the decision of the customer, Yellow Dog will assess a $100.00 handling charge to all deposits and payments received. In addition, each individual lodge, outfitter, and destination may charge their own handling and/or administration fee. All cancellations must be given in writing to Yellow Dog. Please keep in mind that Yellow Dog and all customers must adhere to each individual lodge or outfitter cancellation and refund policy, which supersedes cancellation terms stated below. Lodges and outfitters that have their own policies are listed below by region and country. For the few lodges and outfitters that do not specify or list their own cancellation/refund policy, or for the lodges and outfitters that have not published said policies, then all cancellations will adhere to the following terms and conditions:

• Cancellation outside of 90 days = A portion of the trip deposit or final payment may be refunded or credited for a future trip, or transferred to another date or angler.
• Cancellation inside of 90 days = No refunds of deposit or payment, and no trip credits.
• On cancellation notices inside of 90 days, partial refunds/transfers may be made IF suitable replacement is provided by customer.

GENERAL

• Yellow Dog and its members, officers, principals, employees, and agents, have no liability or responsibility for the acts or omissions of any third-party contractors, outfitters, airlines, railroads, ship owners, charter air carriers, shuttle and taxi drivers, hotels, lodges, fishing guides or other service providers (“Third Parties”) engaged by Yellow Dog on behalf of the customer, or customer directly, in connection with any trip. Customer shall hold Yellow Dog and its members, officers, principals, employees and agents harmless from any and all claims, damages, expenses, penalties, liabilities, or attorney’s fees, resulting from the acts or omissions of Third Parties including consequential, direct, indirect, incidental, punitive, or special damages to property or persons.
• Further, customer is subject to all tariffs, terms, and conditions of all tickets, vouchers, and contracts of such lodges, outfitters, hotels, airlines, railroads, operators, owners and contractors issued in connection with the trip, and the issuance and acceptance of any such tickets, vouchers and contracts shall be deemed to be consent to such conditions.
• Yellow Dog in its sole discretion reserves the right to: (1) make such alterations in the trip itinerary as it deems necessary or desirable, (2) to refuse to accept or retain as a customer, any person at any time (in such case refund will be based on the actual cost of the unfinished portion of tour), and (3) to pass on to customers all expenditures occasioned by delays or occurrences beyond Yellow Dog’s control.
• Yellow Dog reserves the right in its sole discretion to cancel any trip prior to departure, in which case full refunds will constitute full settlement to any customer. Prices quoted are based on foreign exchange values and tariffs currently in effect, and prices are subject to change.
• Baggage and personal effects of customer, including items purchased, are always the sole responsibility of such customer and no agent of Yellow Dog is authorized to accept these for storage, safekeeping, or transportation.
• Customer agrees to comply with any codes, laws, orders, ordinances, regulations, and statues of any government authority for any trip destination including layovers.
• EXCEPT AS EXPRESSLY STATED HEREIN, YELLOW DOG DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, TO CUSTOMER, AND HEREBY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES ARISING FROM A COURSE OF DEALING AND WARRANTIES OF MERCHANTABILITY; FITNESS FOR A PARTICULAR PURPOSE; SECURITY OR ACURACY.
• Yellow Dog Flyfishing, L.L.C. is a Montana-based limited liability company. These terms and conditions shall be subject to and enforced in accordance with the laws of Montana USA. In the event of a dispute, all parties submit to the jurisdiction and venue of the state courts of Bozeman, Montana USA.
• These terms and conditions constitute the entire agreement of the parties with respect to the subject matter hereof and supersede all previous written or oral agreements between the parties with respect to such subject matter.
• Yellow Dog shall not be liable for any nonperformance or delay in performance caused by any act or event beyond its reasonable control, including without limitation acts or omissions of Third Parties, unavailability of supplies or labor, equipment failure, war, strikes, lock-outs, fire, flood, earthquake, hurricane, disease, epidemic, pandemic, plague, quarantine, any other Act of God, any law, regulation, ordinance, or other act or order of any court, government, or governmental agency.

SELECTION
The product selection at Yellow Dog Flyfishing includes one of the most complete product assortments an angler or fly tyer will ever come across. We carry offerings from nearly every significant and proven manufacturer in the fly-fishing industry and are always on the “hunt” for more partnerships. We simply can’t carry everything, but we offer the best choices across multiple price points – that an angler can find right here in our Bozeman-based fly shop.

PRICING POLICIES
We use the Manufacturers Suggested Retail Price (MSRP) for our retail pricing. Items that vary from MSRP may be found during special promotional periods or include items that are no longer being carried in our Bozeman-based fly shop or discontinued by the manufacturer. You may find a color or size of a particular item that is marked down compared to other sizes or colors of the same item – typically these marked downsizes/colors are being discontinued by either Yellow Dog Flyfishing or the manufacturer.

Yellow Dog Flyfishing will match competitor (online or local) offers on new, current, in-stock items. Proof of offer must be provided via email or in-person for consideration and we reserve the right to decline participation in matching the offer if we deem the offer violates the pricing policy set in place by our partner manufacturers.
